Why Days Has No Case Against Tate Black

We understand that EJ is very, very angry on Days of our Lives. He and Nicole just lost “their” baby, and now his wife has to deal with her daughter lying in a coma due to a drug overdose. We understand EJ feels helpless and that he thinks bringing Tate to justice is the one thing he can do to help Nicole. But we also understand that Salem’s District Attorney has no case, prima facie (at first sight) or otherwise.

Tate Black: Time Enough To Last

One of EJ’s (Dan Feuerriegel) charges against Tate (Jamie Martin Mann) is that he waited too long to get Holly (Ashley Puzemis) medical help, which worsened her condition. Um…how does he know that? More importantly, how could he prove it?

EJ has no idea and no evidence about what time Tate found Holly, and how much time passed between then and when the police arrived. All he has is the time the cops arrived on the scene, presumably, but even if there is video footage of when Tate left the party to find Holly, there is absolutely nothing to determine how long it was until he found her. (Though he does have his confession.)

Drug Pusher

EJ is convinced that Tate gave Holly the drugs which she overdosed on. His only evidence is that Tate was holding the remainder when they found them. Tate says he found them in Holly’s possession and picked them up. That’s a pretty natural impulse.

Unless EJ can find the dealer who sold the drugs to Tate, he can’t prove purchase. Furthermore, Holly told Tate she bought the “ADD meds” from a friend at school. It’s EJ’s — or, at least, Rafe’s (Galen Gering) — job to follow up on that story. And once he finds the culprit, there goes EJ’s only bit of physical evidence.
